Amicus curiae is latin for “friend of the court”. A procedure in which a third party to a case can assit the court in the public interest. In human rights cases these briefs usually cover international and comparative law and/or factual information on a situation, on specific issues.

Svinia Housing Case

The applicants in the present action were denied local permanent residence by the local governing authorities because they live in informal, though long-term, housing structures. The overall effect and likely intention of the authorities’ denial of local permanent residence is to discourage and inhibit non-native Roma from settling in the village’s Romani settlement, in violation of the applicants’ right to freedom of movement. Because this interference with the applicants’ fundamental right cannot be justified as necessary or proportionate to any legitimate aim, ERRC urged the Court to find that the authorities have acted in violation of international and Slovak law.
