Proceedings Discontinued: The Inertia of Roma Rights Change in Ukraine

Roma in Ukraine are extremely vulnerable to infringements of fundamental human rights. A number of very serious instances of violent human rights abuse have taken place in Ukraine in recent years. In addition, systematic issues, such as widespread racial discrimination in a number of sectoral fields and the exclusion of Roma from personal and other documents, remain entirely unaddressed by government action to date.
Matters documented in detail by the European Roma Rights Centre (ERRC) and partner organisations in this report include: violence, including racially motivated violence and extreme forms of violence by state and non-state actors; racial targeting, racial profiling and racial discrimination in criminal justice matters, including the systematic data-basing of Roma by the police in Ukraine; racial discrimination in social and economic areas, including housing, health care, education, employment and social services; widespread lack of personal and other documents, effectively denying Roma the right to a legal personality, thwarting access to basic services, and hindering even basic civil and political participation.
Current Ukrainian laws are not sufficient to adequately protect against or punish acts of racial discrimination. This lack of legal capacity has been noted by international observers for many years. The absence of any comprehensive anti-discrimination law in Ukraine makes it virtually impossible for victims of discrimination in Ukraine to use legal means to secure justice. Furthermore, even in areas where some legal provisions and mechanisms do exist, government authorities and the judicial system continue to be unable or unwilling to utilize them to bring about meaningful change for Roma in Ukraine. This report aims to provide a summary of ERRC documentation in a number of areas of relevance to international human rights law.

ERRC Country Report: Always Somewhere Else: Anti-Gypsyism in France

France is known as a country of human rights. "Freedom, Equality and Brotherhood" – these declarations remain at the heart of the French Republic. Despite these commitments, hundreds of thousands of Gypsies and Travellers in France are denied the very basic right of equal treatment and experience regular denial and interference with almost all fundamental civil, political, social, economic and cultural rights. They have long been subjected to laws, policies and practices aimed at their control, repression, exclusion and assimilation, that affect almost all aspects of their daily life. Recently, a number of new laws have severely constricted possibilities for the expression of key elements of Gypsy and Traveller identity, while simultaneously providing racist local officials with legal justification for repressive and draconian measures aimed at – and succeeding in achieving – the exclusion of Gypsies and Travellers from nearly all elements of French public life and services. |

ERRC Country Report: In Search of Happy Gypsies: Persecution of Pariah Minorities in Russia

ERRC monitoring of Roma rights in Russia has revealed an alarming pattern of human rights abuse of Roma and other people perceived as "Gypsies". The magnitude of the abuse is only comparable to that of the perpetrators’ impunity. Anti-Romani racism is widespread in Russia today. The law guarantees equal treatment and protection against discrimination of all people in Russia, yet Roma, among several other ethnic minorities, find themselves excluded from the equal protection of the law, or in fact frequently any protection of the law. Indeed, the authorities whose duty is to uphold human rights are often themselves implicated in gross human rights violations or acquiesce in them. Violence and abuse of Roma by law enforcement and judicial authorities, often motivated by racial animus, persists unchallenged and unremedied. Racism also effectively precludes many Roma from accessing education, health care, housing, employment, and public services. |
