ERRC v France, Collective Complaint 51/2008 (discrimination, housing, social protection)

The European Roma Rights Centre filed a collective complaint against France, under the Revised European Social Charter, asking the Committee to hold that housing-related injustices in France (including but not limited to social exclusion, forced evictions, inadequate access to housing, lack of access to basic utilities) amounted to a violation of several rights established by the Revised Charter.

The Committee held that there was a violation of Article 31§1 of the Revised Charter (failure to promote access to housing of an adequate standard), as well as of Article 31§2 of the Revised Charter on the ground of the eviction procedure and other penalties. The Committee found a violation of Article E taken in conjunction with Article 31 of the Revised Charter (the right to housing), as well as of Article 16 (the right of the family to social, legal and economic protection) and Article E taken in conjunction with Article 16 of the Revised Charter. France was found in violation of Article 30 (the right to protection against poverty and social exclusion) and of Article 30 read in conjunction with the non-discrimination clause, as well.
